    These Terms & Conditions explain the rules that apply when you visit OldBikeBarn.com or place an order with us. We have written them in plain language so they are easier to understand.

    OldBikeBarn.com is operated by MC Distributing. In these terms, “Old Bike Barn,” “we,” “us,” and “our” refer to OldBikeBarn.com and MC Distributing. “Customer,” “you,” and “your” refer to the person using our website or placing an order.

    1. Acceptance of These Terms

    By using this website or submitting an order, you agree to these Terms & Conditions and to the policies linked from this page. If you do not agree, please do not use the website or place an order.

    You must have the legal capacity to enter into a purchase agreement. If you place an order for another person or business, you confirm that you are authorized to do so.

    2. Orders and Order Acceptance

    Submitting an order does not automatically mean that we have accepted it. An order is an offer by the customer to purchase the listed products. An automated order confirmation only confirms that we received the order.

    An order may be accepted after it has been reviewed, payment has been approved, and the order has entered fulfillment or been shipped.

    Our right to refuse, change, or cancel an order: Before shipment, we reserve the right to refuse, hold, correct, limit, partially fulfill, or cancel an order when reasonably necessary. This includes suspected fraud, payment problems, inventory shortages, pricing or website errors, incorrect customer information, unusually large quantities, resale activity, export restrictions, safety concerns, or circumstances that prevent reasonable fulfillment.

    We may remove an unavailable item, adjust an incorrectly entered quantity, divide an order into separate shipments, or partially cancel an order. If this occurs, we will refund the amount paid for any cancelled item and any applicable related charge.

    If we cancel an entire order, we will issue a refund to the original payment method. We will not charge a higher price for an affected product without the customer’s authorization.

    We may contact the customer to verify identity, payment information, billing or shipping addresses, motorcycle application, or other order details. We may hold or cancel the order if reasonable verification cannot be completed.

    3. Customer Changes and Cancellations

    Orders move into processing quickly. We cannot guarantee that an order can be changed, combined, redirected, or cancelled after it is submitted.

    Contact us immediately if you notice a mistake. If the order has not been processed or shipped, we will try to help. Once an order has entered fulfillment, the applicable return process may be required.

    4. Product Information and Website Errors

    We work to keep product descriptions, fitment information, photographs, prices, quantities, inventory, dimensions, specifications, and availability accurate. However, typographical, technical, supplier, data-entry, and display errors can occur.

    We reserve the right to correct website information at any time and to cancel an affected order before shipment. If a product was listed at an obviously incorrect price or with materially incorrect information, we are not required to supply it on the incorrect terms where permitted by law.

    Product colours, finishes, markings, packaging, and minor details may differ from photographs because of lighting, screen settings, manufacturing variations, supplier changes, or production updates. Minor non-functional differences do not necessarily mean that a product is defective.

    5. Prices, Currency and Taxes

    Prices may change without notice. The price shown during checkout, subject to correction of errors, is the price used for the order.

    Customers are responsible for applicable sales taxes, duties, import charges, brokerage fees, or government assessments unless the checkout or shipping offer specifically states that we will pay them.

    Banks and payment providers may apply currency-conversion rates or additional fees. These charges are controlled by the payment provider and not by Old Bike Barn.

    6. Payment and Fraud Prevention

    Payment must be successfully authorized before an order is fulfilled. Some payment methods may require additional processing time.

    We may use fraud-screening services and request reasonable verification. We may hold or cancel an order if the payment cannot be verified, appears unauthorized, or presents an unacceptable fraud or chargeback risk.

    The customer confirms that they are authorized to use the submitted payment method and that all payment and billing information is accurate.

    7. Motorcycle, ATV and Product Fitment

    Motorcycle and ATV parts can differ by manufacturer, model, year, market, production date, trim, engine, carburetor, electrical system, previous modifications, and original equipment configuration. Customers must read the complete product description and verify the listed application before ordering.

    A reference to an original equipment manufacturer number is provided for identification or cross-reference purposes unless the product is specifically identified as genuine OEM.

    Do not assume that a product fits solely because it resembles the original part or because the vehicle falls within a broad model family. Contact us before ordering if the application is unclear.

    Unless expressly confirmed otherwise in writing, customer-service advice is based on information supplied by the customer. Incorrect, incomplete, or inaccurate vehicle information may result in an incorrect recommendation.

    The customer is responsible for identifying modifications, engine swaps, carburetor changes, electrical conversions, aftermarket components, or other changes that may affect product compatibility.

    Universal and Custom Parts

    Products described as universal or custom are not guaranteed to bolt directly onto every motorcycle or ATV. They may require measurement, fabrication, wiring changes, brackets, spacers, adapters, tuning, modification, or professional installation.

    The customer is responsible for checking all listed measurements, specifications, mounting requirements, electrical requirements, and legal restrictions before purchasing or modifying a universal or custom part. A product that has been modified or installed may no longer qualify for a return.

    8. Installation, Inspection, Maintenance and Assumption of Risk

    Motorcycles, ATVs, powersports vehicles, replacement parts, repairs, and modifications involve inherent risks. Incorrect selection, installation, adjustment, maintenance, or use of a product may cause product failure, loss of vehicle control, property damage, serious personal injury, or death.

    Before installation, the customer or installer must confirm that the product is correct for the vehicle and intended application. Every product must be inspected for damage, defects, missing components, shipping damage, and proper fit before it is installed or used.

    Do not install or use any product that appears damaged, defective, incomplete, incorrect, or unsuitable. Contact Old Bike Barn before installation if there is any uncertainty.

    Products must be installed, adjusted, tested, inspected, and maintained correctly using the applicable factory service manual, proper tools, current specifications, and recognized motorcycle or powersports repair procedures. Instructions supplied with a product do not replace the applicable factory service manual or professional judgment.

    Installation should be performed by a qualified technician whenever the customer does not have the necessary knowledge, experience, tools, or equipment.

    Brake, steering, suspension, wheel, tire, fuel, throttle, engine, drive, and electrical components are safety-critical. Installation, adjustment, and inspection of these systems require particular care.

    After installation and before operation, all work must be inspected and tested in a safe and appropriate manner. Fasteners, adjustments, clearances, fluid levels, leaks, electrical operation, braking operation, steering, and other affected systems must be checked as appropriate.

    Products and affected systems must also be periodically inspected, adjusted, and maintained after installation. Stop operating the vehicle immediately if a defect, unusual operation, warning sign, or unsafe condition becomes known or reasonably apparent.

    Assumption of risk: To the fullest extent permitted by law, the customer and installer knowingly accept the risks associated with selecting, installing, modifying, maintaining, and using motorcycle, ATV, and powersports parts. The customer is responsible for ensuring that the vehicle is safe, roadworthy, properly maintained, and legal for its intended use.

    To the fullest extent permitted by law, Old Bike Barn is not responsible for injury, death, vehicle damage, property damage, or other loss resulting from incorrect fitment, improper installation, improper adjustment, failure to inspect or maintain a product, misuse, abuse, neglect, unauthorized modification, racing, competition, stunt use, off-road use, continued use after a problem becomes apparent, or failure of another vehicle component.

    The customer is responsible for confirming that each modification and product is legal for the intended street, racing, competition, show, or off-road use in the applicable jurisdiction.

    9. Racing, Off-Road and Competition Use

    Racing, competition, stunt, and off-road use place greater loads on vehicles and components and involve additional risk. Unless a product listing or written warranty expressly states otherwise, products are not represented as suitable for professional racing or competition.

    Products marked “off-road use only,” “competition use only,” or similar wording must not be used on public roads where prohibited. The customer is solely responsible for compliance with applicable vehicle, emissions, noise, equipment, and road-use laws.

    10. Shipping and Delivery

    Shipping dates and delivery estimates are estimates and not guarantees unless we expressly agree otherwise in writing. Delays may occur because of carriers, weather, customs, address problems, labour disruptions, emergencies, or other circumstances outside our reasonable control.

    Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address, refused delivery, unclaimed shipment, or unauthorized redirection may be deducted from a refund or charged to the customer where permitted by law.

    Orders may be divided into more than one shipment. Review our Shipping Information for current shipping details.

    Missing, Damaged or Incorrect Shipments

    Inspect the package and its contents promptly after delivery. If an item is missing, damaged, or incorrect, contact us as soon as reasonably possible.

    Keep the product, packaging, shipping carton, labels, and packing material because photographs, documentation, or carrier inspection may be required.

    11. Returns and Refunds

    Eligible returns are governed by our Return Policy. Please read that policy before installing, modifying, or returning a product.

    Returned products are subject to inspection. A refund may be refused or reduced when a product is used, installed, altered, damaged, incomplete, contaminated, returned outside the eligible period, or otherwise excluded by the Return Policy, except where applicable law requires another remedy.

    Shipping costs are not refundable unless stated in the Return Policy, the return results from our error, or applicable law requires reimbursement.

    Customers must follow the published return process and receive return instructions before sending a product back. Unauthorized returns may be refused or delayed.

    12. Warranties

    Unless a different written warranty is provided with a product or in its listing, warranty remedies are limited to those offered by the applicable manufacturer or supplier and those required by law.

    Warranty claims may require proof of purchase, photographs, testing information, installation details, return of the product, and other information reasonably needed to assess the claim.

    Warranty coverage does not apply to ordinary wear, misuse, incorrect fitment, improper installation, neglect, accidents, racing or off-road use where excluded, unauthorized modification, improper maintenance, corrosion, electrical-system faults, or damage caused by another failed component, except where applicable law provides otherwise.

    The installation of a replacement component does not correct an underlying fault elsewhere on the vehicle. The customer or installer is responsible for identifying and correcting the condition that caused the original component to fail.

    Any legal warranties or consumer rights that cannot lawfully be excluded remain in effect.

    13. Disclaimer and Limitation of Liability

    To the fullest extent permitted by law, products and website information are provided without guarantees beyond those expressly stated in writing or required by applicable law.

    Technical information and customer-service guidance are general information based on the details available to us. They are not a substitute for physical inspection of the vehicle, the applicable factory service manual, or the judgment of a qualified technician.

    To the fullest extent permitted by law, Old Bike Barn, MC Distributing, and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers will not be liable for:

    • Personal injury or death arising from improper product selection, installation, adjustment, inspection, maintenance, modification, or use;
    • Damage caused by using a product on an unlisted, modified, unsuitable, or incorrectly identified vehicle;
    • Damage caused by misuse, abuse, neglect, racing, competition, stunt use, or unauthorized off-road use;
    • Damage caused by another worn, damaged, incompatible, defective, or incorrectly installed component;
    • Labour, towing, recovery, diagnostic, storage, travel, accommodation, rental, removal, or reinstallation costs;
    • Loss of vehicle use, riding time, revenue, profit, business, opportunity, data, or goodwill; or
    • Indirect, incidental, special, exemplary, punitive, or consequential damages.

    To the fullest extent permitted by law, our total combined liability for any claim relating to a product, order, website use, or customer-service communication will not exceed the amount actually paid to Old Bike Barn for the specific product giving rise to the claim.

    These limitations apply regardless of whether a claim is based on contract, warranty, negligence, product liability, misrepresentation, statute, or another legal theory, and even if the possibility of loss was known or reasonably foreseeable.

    Legal rights are not removed: Nothing in these terms excludes or limits liability for fraud, wilful misconduct, gross negligence where it cannot legally be excluded, or any warranty, remedy, consumer right, personal-injury claim, or other liability that applicable law does not allow us to exclude or limit.

    14. Customer Responsibility, Release and Indemnity

    To the fullest extent permitted by law, the customer accepts responsibility for the vehicle, the selected product, the accuracy of vehicle information supplied to us, the choice of installer, and the inspection, installation, adjustment, testing, maintenance, and lawful use of the product.

    To the fullest extent permitted by law, the customer releases Old Bike Barn, MC Distributing, and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers from claims arising from:

    • The customer’s or installer’s incorrect product selection;
    • Improper installation, adjustment, inspection, testing, or maintenance;
    • Use on a vehicle or application not listed in the product description;
    • The customer’s modification, misuse, neglect, racing, or unlawful use of a product;
    • Failure to stop using a product or vehicle after a defect, warning sign, or unsafe condition becomes known or reasonably apparent; or
    • Inaccurate or incomplete information supplied by the customer.

    To the fullest extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Old Bike Barn, MC Distributing, and their owners, directors, officers, employees, representatives, suppliers, contractors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal costs caused by the customer’s unlawful conduct, material breach of these terms, improper installation or resale of a product, misuse of a product, or intentional misconduct.

    This section does not require a customer to release or compensate Old Bike Barn for liability caused solely by our fraud, wilful misconduct, or other conduct for which liability cannot legally be excluded.

    15. Website Use and Intellectual Property

    Website text, photographs, graphics, logos, guides, downloads, product organization, and other original content are owned by or licensed to Old Bike Barn and are protected by applicable intellectual-property laws.

    The website may be used for personal shopping and informational purposes. Website content or systems may not be copied, scraped, republished, sold, commercially exploited, interfered with, or misused without written permission.

    Honda, Yamaha, Kawasaki, Suzuki, and other manufacturer and model names may be trademarks of their respective owners. Their use identifies product compatibility and does not imply sponsorship or endorsement unless expressly stated.

    16. Third-Party Services and Links

    The website may use or link to third-party services, including Shopify, payment providers, couriers, financing providers, product-review services, and shipment-protection providers.

    Those services may have their own terms and privacy practices. We are not responsible for independent third-party websites or services outside our control.

    17. Privacy

    Personal information is handled according to our Privacy Policy.

    Information may be shared with service providers when reasonably necessary to process payments, fulfill orders, deliver shipments, prevent fraud, provide customer service, operate the website, comply with legal obligations, or protect our rights.

    18. Events Outside Our Control

    We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural events, severe weather, fire, flood, war, civil disruption, government action, customs delays, carrier interruptions, labour disputes, utility or internet outages, cyber incidents, epidemics, supplier failures, or transportation shortages.

    In these circumstances, we may delay, allocate, partially fulfill, or cancel affected orders and refund any amount paid for products we cannot supply.

    19. Governing Law

    These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.

    Subject to any mandatory consumer rights in the customer’s jurisdiction, disputes will be brought before the courts located in Ontario, Canada.

    20. Changes to These Terms

    We may revise these Terms & Conditions to reflect changes to our business, website, policies, products, or legal obligations.

    The updated version takes effect when posted and applies to future website use and future orders. Changes will not retroactively alter an already accepted order unless required by law or agreed with the customer.

    21. Severability and No Waiver

    If any part of these terms is found invalid or unenforceable, that part will be limited or removed only to the minimum extent necessary. The remaining terms will continue to apply.

    Our failure to enforce a term on one occasion does not waive our right to enforce that term or another term later.

    22. Entire Agreement

    These Terms & Conditions, together with the applicable product listing, order information, Return Policy, Shipping Information, Privacy Policy, and any written product warranty, form the agreement relating to use of this website and the purchase of products.

    If a product listing contains a specific term that conflicts with a general term on this page, the product-specific term applies to that product.
